These Terms & Conditions ("Terms") form a binding agreement between you and Foldy
Technologies Pvt. Ltd. ("Foldy", "we", "us") governing your access to and use of the Foldy
website, mobile applications and related services (together, the "Service").
By creating an account, or by accessing or using the Service, you confirm that you have
read, understood and agree to these Terms and to our
Privacy Policy. If you do not agree, do not use the Service.
2. Definitions
Account: the personal account you create to access the Service.
Content: documents, files, data and information you upload, import or store.
Plan: the free or paid subscription tier applying to your Account.
Service: the Foldy financial and compliance locker in all its forms.
3. Eligibility & Registration
You must be at least 18 years old and legally able to enter a contract.
You must provide accurate, current and complete registration information.
You may be asked to verify your identity before certain features are enabled.
One person or legal entity may not maintain more than one free Account.
If you use the Service on behalf of an organisation, you confirm you are authorised to
bind that organisation to these Terms.
4. Your Account & Security
You are responsible for everything that happens under your Account.
Keep your password and any two-factor credentials confidential.
Enable the security features we make available, including 2FA and biometric login.
Notify us immediately at info@foldy.co.in if you suspect
unauthorised access.
Zero-knowledge note. Because your documents are encrypted so that we
cannot read them, we may be unable to recover your Content if you lose your credentials.
Keep your recovery information safe.
5. Acceptable Use
You May
Store, organise and retrieve your own financial and compliance documents
Import records from authorised sources where you have given consent
Export your Content at any time in the formats we provide
You May Not
Upload content you do not own or have no right to store
Use the Service for money laundering, tax evasion or any unlawful purpose
Attempt to breach, probe or reverse engineer the Service or its security
Resell, sublicense or provide the Service to third parties without written consent
Upload malware, or interfere with the Service's operation or other users
Use automated means to scrape or extract data beyond documented interfaces
6. Plans, Billing & Refunds
Free plan: offered with the storage and feature limits published at signup.
Paid plans: billed in advance on a recurring basis until cancelled.
Renewal: subscriptions renew automatically; cancel before the renewal date to avoid
the next charge.
Cancellation: you keep access until the end of the paid period.
Failed payments: we may suspend paid features after a reasonable retry period.
Refunds are handled case by case and are generally not provided for periods already
elapsed, except where required by law.
7. Your Documents & Content
Your Content remains yours. You grant us only the limited licence needed to host,
encrypt, back up and display it to you so we can operate the Service.
We do not sell your Content, and we do not use it for advertising.
We access Content only at your request, for example to resolve a support issue.
You are responsible for the accuracy and lawfulness of what you upload.
You may export or delete your Content at any time.
Retention after deletion is described in our
Privacy Policy.
8. Third-Party Services
The Service integrates with third parties such as government data sources, payment
processors and analytics providers. Your use of those services is governed by their own
terms, and we are not responsible for their availability, accuracy or acts.
Where we fetch records on your behalf, we do so only with your consent and only from
authorised sources.
9. Intellectual Property
The Service, including its software, design, branding and documentation, is owned by
Foldy and protected by intellectual property laws. These Terms grant you a limited,
non-exclusive, non-transferable, revocable right to use the Service for its intended
purpose. No other rights are granted.
Feedback you send us may be used to improve the Service without obligation to you.
10. Availability & Changes
We aim for high availability but do not guarantee uninterrupted service.
Planned maintenance will be announced in advance where practical.
We may add, change or withdraw features as the product evolves.
If we discontinue a material feature, we will give reasonable notice and an export path.
11. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by
law, we disclaim all implied warranties, including merchantability, fitness for a
particular purpose and non-infringement.
Not professional advice. Foldy is a document storage and organisation
tool. Nothing in the Service constitutes tax, legal, accounting or financial advice.
Always verify filings and deadlines with a qualified professional.
12. Limitation of Liability
To the maximum extent permitted by law, Foldy will not be liable for indirect,
incidental, special, consequential or punitive damages, or for loss of profits, revenue,
data or goodwill.
Our total aggregate liability arising out of or relating to the Service will not exceed
the amount you paid us in the twelve months preceding the event giving rise to the claim,
or INR 5,000 if you use a free plan.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
13. Suspension & Termination
You may close your Account at any time from your settings or by contacting support.
We may suspend or terminate an Account that breaches these Terms, poses a security risk, or where
required by law.
Where practical, we will give notice and an opportunity to fix the issue first.
On termination you may export your Content for a reasonable period before deletion.
Sections covering intellectual property, disclaimers, liability and governing law
survive termination.
14. Governing Law & Disputes
These Terms are governed by the laws of India. The courts at the location of Foldy's
registered office have exclusive jurisdiction, subject to any mandatory consumer
protections available to you.
Before starting formal proceedings, please contact us so we can try to resolve the
matter directly.
Changes to These Terms
We may update these Terms from time to time. Material changes will be notified by email
or by prominent notice in the Service. Continued use after the effective date means you
accept the updated Terms.
